What is Mediation?

Mediation is a process where the parties to legal proceedings agree for a third-party to communicate with each party individually to try to come to a resolution to all disputes that are agreeable to all parties. The mediator will assist in drafting a written settlement agreement that will be signed by all parties that will contain the terms of the settlement. The settlement agreement becomes a legally binding enforceable contract between the parties.

Benefits of Mediation

  • Resolution & Saves Time and Expense. Disputes involving trusts and estates can drag on for years and be a huge financial drain on families. The time and expense for legal counsel to prepare your case for trial before a Judge or jury can be immense. Mediation allows a case to be settled immediately, and all issues resolved.
  • Unique Solutions. A Judge or jury is often limited to what they can do when deciding a case. This “All or Nothing” result can often be avoided by mediation. A skilled and knowledgeable mediator can craft a unique agreement to make it a win-win situation for all parties.
  • Mediation allows the parties to communicate in a confidential setting.
  • Informal Setting. The Mediation process occurs outside a Court setting and can be held at the mediator’s office or at a mutually agreeable location.
  • Narrowing Down the Issues. Parties in a dispute often feel that the other side is “fighting about everything.” A skilled mediation can quickly identify the key issues that need to be addressed and resolved.

Downside of Mediation

The short answer is that there is no real downside. While mediation may take additional time and expense, if the mediation is successful, it will be more cost effective than going to Court. If the mediation is unsuccessful, the parties often narrow down the issues between the parties. Also, matters discussed in the mediation and proposed settlement terms are confidential and often can not be used as evidence in Court or at trial.

Convenience and Flexibility

The Chenault Law Firm has excellent mediation facilities which allow our mediators to meet with the parties separately providing quality surroundings to ensure a relaxing environment.  Our mediators are also available to travel to a location agreed to by the parties to hold the mediation.
